Trailer Rental Agreement For purposes of this Agreement: Owner: The Yard Spot LLC d/b/a The Trailer Spot. Renter: The individual or business signing this Agreement. Rental Period The rental begins and ends on the dates and times listed in this Agreement. The trailer must be returned to the agreed location by the return time unless an extension has been approved by Owner. Rental Charges Renter agrees to pay all rental charges, taxes, fees, and any additional amounts due under this Agreement. Card on File Authorization Renter authorizes Owner to retain a valid credit or debit card on file and to charge that card for any amounts due under this Agreement, including but not limited to: * Rental charges * Late fees * Fuel or battery-related charges (if applicable) * Cleaning charges * Damage repair costs * Missing equipment or accessories * Tire, wheel, or road hazard damage * Towing, recovery, impound, or repossession expenses * Administrative fees * Collection costs If charges exceed the available card balance, Renter remains responsible for the remaining balance. Inspection and Acceptance Renter acknowledges that they have inspected the trailer before taking possession and accept it as being in safe operating condition unless otherwise noted on the inspection form. Renter agrees to immediately report any mechanical issues or damage discovered during the rental period. Permitted Use The trailer may only be used for lawful purposes. Renter shall not: * Allow anyone not authorized by Owner to tow or operate the trailer. * Sublease or loan the trailer. * Transport illegal materials. * Overload the trailer beyond its rated capacity. * Modify or repair the trailer without written permission from Owner. Tow Vehicle Requirements Renter certifies that their tow vehicle is properly equipped and rated to safely tow the trailer and cargo. Owner makes no representation regarding compatibility between the trailer and Renter’s vehicle. Renter is solely responsible for: * Proper hitch connection * Safety chains * Breakaway cable * Trailer wiring * Brake controller * Load securement * Safe towing practices Maintenance and Damage Renter is responsible for protecting the trailer from damage throughout the rental period. Normal wear and tear does not include: * Bent ramps * Tire punctures or blowouts * Wheel damage * Jack damage * Winch cable damage * Broken lights * Hydraulic damage * Bent fenders * Bent frame or tongue * Interior damage * Paint or structural damage * Damage resulting from misuse, overloading, negligence, or improper operation Renter agrees to immediately stop using the trailer if a mechanical issue develops that could reasonably cause additional damage. If continued operation causes additional damage, Renter is responsible for all resulting repairs. Cleaning Trailers must be returned reasonably clean and free of debris. Excessive mud, concrete, asphalt, roofing materials, landscaping debris, animal waste, or other unusual contamination may result in a cleaning fee of up to $150. Liability Renter assumes all risk arising from possession, loading, towing, unloading, and use of the trailer. Owner shall not be liable for: * Personal injury * Death * Property damage * Cargo damage * Vehicle damage * Business interruption * Lost profits * Indirect or consequential damages This includes, but is not limited to, accidents involving: * Winches * Winch cables * Hydraulic systems * Dump mechanisms * Ramps * Batteries * Electrical systems * Tires * Couplers * Jacks * Any trailer accessory or component. Insurance Renter is responsible for maintaining any insurance required by law and for verifying that their insurance covers the rented trailer. Owner provides no insurance coverage for the trailer, cargo, or Renter. Late Returns A trailer returned more than three (3) hours after the scheduled return time without prior approval will incur a late charge equal to two (2) times the daily rental rate. If the trailer is not returned and Owner cannot contact Renter, Owner may recover the trailer by lawful means, charge all associated costs to Renter, and report the trailer as unlawfully retained if appropriate under applicable law. No refunds are provided for early returns. Rental Extensions Extensions are subject to trailer availability. Approved extensions are billed at the normal rental rate plus a 25% extension fee. Recovery Costs If Owner must recover the trailer due to default, abandonment, or failure to return, Renter agrees to pay all reasonable recovery, towing, storage, repossession, attorney’s fees, court costs, and collection expenses. Renter agrees to grant access to any property that they have the rental trailer on, if pickup becomes necessary. Batteries Owner does not guarantee batteries will remain charged during the rental period. Traffic Violations Renter is responsible for all: * Parking tickets * Toll charges * Traffic citations * Weight violations * Impound fees * Government fines incurred during the rental period. Governing Law This Agreement shall be governed by the laws of the Commonwealth of Virginia. Any legal action arising from this Agreement shall be brought exclusively in the state courts serving the county or city in which Owner’s principal place of business is located, unless otherwise required by law. Entire Agreement This Agreement constitutes the entire agreement between the parties and supersedes all prior oral or written agreements. By agreeing to these terms, whether electronically or by signature,, Renter acknowledges that they have read, understood, and agree to all terms and conditions of this Agreement.
