In this rental agreement, Owner refers to lawful owner of rental company, The Yard Spot LLC DBA The Trailer Spot. Customer refers to individual or business that signs this contract to rent equipment from the Owner. • The rental period shall begin and end at specified time and date at bottom of agreement. The Renter agrees to return the trailer to the Owner at the end of the rental period in the same condition as received, except for normal wear and tear. • The Renter agrees to pay the Owner a rental fee specified at bottom of agreement for the duration of the rental period. The security deposit will be refunded to the Renter within 7 days after the return of the trailer, minus any deductions for damages, missing equipment, excessive cleaning, or additional charges incurred during the rental period. • The Renter agrees to use the trailer solely for lawful purposes and in compliance with all applicable federal, state, and local laws and regulations. The Renter shall not sublease, loan, or otherwise transfer the trailer to any third party without the prior written consent of the Owner. • The Renter shall be responsible for the trailer's maintenance and shall return it to the Owner in the same condition as received, except for normal wear and tear. The Renter agrees to notify the Owner immediately of any accidents, damage, or required repairs. The Renter shall not undertake any repairs or modifications to the trailer without the prior written consent of the Owner. • The Renter agrees to assume all liability for the trailer during the rental period. • The Renter shall be responsible for any damage or loss caused by their use or possession of the trailer beyond normal use. The Renter acknowledges and accepts that excessive dirtiness upon return of the trailer may result in a cleaning charge of $150. The Renter understands that the Owner does not provide insurance coverage for the Renter's personal property or any injuries or damages that may occur during the rental period. The Owner is not responsible for ANY damages or injuries caused by using trailer or accessories, including but not limited to: winch/ winch cable malfunction, dump and hydraulic malfunction, ramp malfunction, and any other trailer part and accessory accident. Renter is responsible to take all safety precautions and use at his/her own risk. • The Renter agrees to tow the trailer only with a vehicle rated for the weight of the trailer. The Owner shall not be held liable for any damage to the Renter's tow vehicle, cargo, or the securing of cargo during the rental period. • Either party may terminate this Agreement with or without written notice to the other party. In the event of termination, the Renter shall promptly return the trailer to the Owner in the same condition as received, except for normal wear and tear. There will be no refunds for early contract terminations. • This Agreement shall be governed by and construed in accordance with the laws of the state of Virginia. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in Amherst county, Virginia. • This Agreement constitutes the entire understanding between the Parties and supersedes all prior agreements, whether written or oral, relating to the subject matter • If Renter does not return trailer at agreed upon time and place, The Owner holds the right to recover by any means necessary without court order. Renter agrees that the Owner is not responsible for damage in recovery process. • Owner does not guarantee batteries will remain charged during rental. • Customer is responsible for noticing and reporting maintenance issues. If customer continues operating trailer with a maintenance issue that causes deeper damage, customer will be charged back for additional damage • Customer will be charged a late fee of 2X daily rate if returned later than 3 hours late. After one day late, trailer will be reported stolen and customer will be prosecuted. • If customer would like to extend rental and the time frame is available, this can be done at 25% extra charge. It is in customers best interest to reserve days needed in advance as often there is discounts applicable for multi day rentals. Your card will be kept on file, and charged for damages or your insurance will be charged.
